  2. BY OPENING THE PACKAGE OR CLICKING ON THE "ACCEPT" 
  3. BUTTON, YOU ARE CONSENTING TO BE BOUND BY AND ARE 
  4. BECOMING A PARTY TO THIS AGREEMENT.  IF YOU DO NOT 
  5. AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, CLICK 
  6. THE "DO NOT ACCEPT" BUTTON OR RETURN THIS PRODUCT TO 
  7. AT&T.
  8.  
  9. NETSCAPE NAVIGATOR END USER LICENSE AGREEMENT
  10.  
  11. GRANT.  Netscape Communications Corporation 
  12. ("Netscape") hereby grants to you a non-exclusive 
  13. license to use its accompanying software product 
  14. ("Software") and accompanying documentation 
  15. ("Documentation") on the following terms:
  16.  
  17. You may:
  18.  
  19.   use the Software only in conjunction with AT&T 
  20.      WorldNet Service;
  21.   use the Software on any single computer;
  22.   use the Software on a second computer so long 
  23.      as the first and second computers are not used 
  24.      simultaneously; or
  25.   copy the Software for archival purposes, 
  26.      provided any copy must contain all of the 
  27.      original Software's proprietary notices.
  28.  
  29. You may not:
  30.  
  31.   use (or permit others to use) the Software 
  32.      separately from AT&T WorldNet Service;
  33.   permit other individuals to use the Software 
  34.      except under the terms listed above;
  35.   modify, translate, reverse engineer, 
  36.      decompile, disassemble (except to the extent 
  37.      applicable laws specifically prohibit such 
  38.      restriction), or create derivative works based 
  39.      on the Software or Documentation;
  40.   copy the Software or Documentation (except for 
  41.      back-up purposes and to review and reproduce 
  42.      off-line any Document displayed in the "Help" 
  43.      section of the AT&T WorldNet Service);
  44.   rent, lease, transfer or otherwise transfer 
  45.      rights to the Software or Documentation; or 
  46.      remove any proprietary notices or labels on 
  47.      the Software or Documentation.
  48.  
  49. SOFTWARE.  If you receive your first copy of the 
  50. Software electronically, and a second copy on media, 
  51. the second copy may be used for archival purposes 
  52. only.  This license does not grant you any right to 
  53. any enhancement or update.
  54.  
  55. TITLE.  Title, ownership, rights, and intellectual 
  56. property rights in and to the Software and 
  57. Documentation shall remain in Netscape and/or its 
  58. suppliers.  The Software is protected by the 
  59. copyright laws of the United States and 
  60. international copyright treaties.  Title, ownership 
  61. rights, and intellectual property rights in and to 
  62. the content accessed through the Software is the 
  63. property of the applicable content owner and may be 
  64. protected by applicable copyright or other law.  
  65. This License gives you no rights to such content.
  66.  
  67. LIMITED WARRANTY.  Netscape warrants that for a 
  68. period of ninety (90) days from the date of 
  69. acquisition, the Software, if operated as directed, 
  70. will substantially achieve the functionality 
  71. described in the Documentation.  Netscape does not 
  72. warrant, however, that your use of the Software will 
  73. be uninterrupted or that the operation of the 
  74. Software will be error-free or secure.  In addition, 
  75. the security mechanism implemented by the Software 
  76. has inherent limitations, and you must determine 
  77. that the Software sufficiently meets your 
  78. requirements.  Netscape also warrants that the media 
  79. containing the Software, if provided by Netscape, is 
  80. free from defects in material and workmanship and 
  81. will so remain for ninety (90) days from the date 
  82. you acquired the Software.  Netscape's sole 
  83. liability for any breach of this warranty shall be, 
  84. in Netscape's sole discretion:  (i) to replace your 
  85. defective media; or (ii) to advise you how to 
  86. achieve  substantially the same functionality with 
  87. the Software as described in the Documentation 
  88. through a procedure different from that set forth in 
  89. the Documentation; or (iii) if the above remedies 
  90. are impracticable, to refund the license fee you 
  91. paid for the Software.  Repaired, corrected, or 
  92. replaced Software and Documentation shall be covered 
  93. by this limited warranty for the period remaining 
  94. under the warranty that covered the original 
  95. Software, or if longer, for thirty (30) days after 
  96. the date (a) of shipment to you of the repaired or 
  97. replaced Software, or (b) Netscape advised you how 
  98. to operate the Software so as to achieve the 
  99. functionality described in the Documentation.  Only 
  100. if you inform Netscape of your problem with the 
  101. Software during the applicable warranty period and 
  102. provide evidence of the date you acquired the 
  103. Software will Netscape be obligated to honor this 
  104. warranty.  Netscape will use reasonable commercial 
  105. efforts to repair, replace, advise or refund 
  106. pursuant to the foregoing warranty within 30 days of 
  107. being so notified.
  108.  
  109. THIS IS A LIMITED WARRANTY AND IT IS THE ONLY 
  110. WARRANTY MADE BY NETSCAPE.  NETSCAPE MAKES NO LONGER 
  111. EXPRESS WARRANTY AND NO WARRANTY OF NONINFRINGEMENT 
  112. OF THIRD PARTIES' RIGHTS.  THE DURATION OF IMPLIED 
  113. WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES 
  114. OF MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR 
  115. PURPOSE, IS LIMITED TO THE ABOVE LIMITED WARRANTY 
  116. PERIOD; SOME STATES DO NOT ALLOW LIMITATIONS ON HOW 
  117. LONG AN IMPLIED WARRANTY LASTS, SO LIMITATIONS MAY 
  118. NOT APPLY TO YOU.  NO NETSCAPE DEALER, AGENT, OR 
  119. EMPLOYEE IS AUTHORIZED TO MAKE ANY MODIFICATIONS, 
  120. EXTENSIONS, OR ADDITIONS TO THIS WARRANTY.  If any 
  121. modifications are made to the Software by you during 
  122. the warranty period; if the media is subjected to 
  123. accident, abuse, or improper use; or if you violate 
  124. the terms of this Agreement, then this warranty 
  125. shall immediately be terminated.  This warranty 
  126. shall not apply if the Software is used on or in 
  127. conjunction with hardware or Software other than the 
  128. unmodified version of hardware and Software with 
  129. which the Software was designed to be used as 
  130. described in the Documentation.
  131.  
  132. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND 
  133. YOU MAY HAVE OTHER LEGAL RIGHTS THAT VERY FROM STATE 
  134. TO STATE OR BY JURISDICTION.
  135.  
  136. LIMITATION OF LIABILITY.  UNDER NO CIRCUMSTANCES AND 
  137. UNDER NO LEGAL THEORY, TORT, CONTRACT, OR OTHERWISE, 
  138. SHALL NETSCAPE OR ITS SUPPLIERS OR RESELLERS BE 
  139. LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, 
  140. SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY 
  141. CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR 
  142. LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR 
  143. MALFUNCTION, OR ANY AN ALL OTHER COMMERCIAL DAMAGES 
  144. OR LOSSES, OR FOR ANY DAMAGES IN EXCESS OF 
  145. NETSCAPE'S LIST PRICE FOR A LICENSE TO THE SOFTWARE 
  146. AND DOCUMENTATION, EVEN IF NETSCAPE SHALL HAVE BEEN 
  147. INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR 
  148. ANY CLAIM BY ANY OTHER PARTY.  THIS LIMITATION OF 
  149. LIABILITY SHALL NOT APPLY TO LIABILITY FOR DEATH OR 
  150. PERSONAL INJURY TO THE EXTENT APPLICABLE LAW 
  151. PROHIBITS SUCH LIMITATION.  FURTHERMORE, SOME STATES 
  152. DO NOT ALLOW THE EXCLUSION OR LIMITATION OF 
  153. INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS 
  154. LIMITATION AND EXCLUSION MAY NOT APPLY TO YOU.
  155.  
  156. TERMINATION.  This license will terminate 
  157. automatically if you fail to comply with the 
  158. limitations described above.  On termination, you 
  159. must destroy all copies of the Software and 
  160. Documentation.
  161.  
  162. EXPORT CONTROLS.  None of the Software or underlying 
  163. information or technology may be downloaded or 
  164. otherwise exported or re-exported (i) into (or to a 
  165. national or resident of) Cuba, Iraq, Libya, North 
  166. Korea, Yugoslavia, Iran, Syria or any other country 
  167. to which the U.S. has embargoed goods; or (ii) to 
  168. anyone on the U.S. Treasury Department's list of 
  169. Specially Designated Nationals or the U.S. Commerce 
  170. Department's Table of Denial Orders.  By downloading 
  171. or using the Software, you are agreeing to the 
  172. foregoing and you are representing and warranting 
  173. that you are not located in, under the control of, 
  174. or a national or resident of any such country or on 
  175. any such list.
  176.  
  177. In addition, if the licensed Software is identified 
  178. as a not-for-export product (for example, on the 
  179. box, media or in the installation process), then the 
  180. following applies:  EXCEPT FOR EXPORT TO CANADA FOR 
  181. USE IN CANADA BY CANADIAN CITIZENS, THE SOFTWARE AND 
  182. ANY UNDERLYING TECHNOLOGY MAY NOT BE EXPORTED 
  183. OUTSIDE THE UNITED STATES OR TO ANY FOREIGN ENTITY 
  184. OR "FOREIGN PERSON" AS DEFINED BY U.S. GOVERNMENT 
  185. REGULATIONS, INCLUDING WITHOUT LIMITATION, ANYONE 
  186. WHO IS NOT A CITIZEN, NATIONAL OR LAWFUL PERMANENT 
  187. RESIDENT OF THE UNITED STATES.  BY DOWNLOADING OR 
  188. USING THE SOFTWARE, YOU ARE AGREEING TO THE 
  189. FOREGOING AND YOU ARE WARRANTING THAT YOU ARE NOT A 
  190. "FOREIGN PERSON" OR UNDER THE CONTROL OF A FOREIGN 
  191. PERSON.
  192.  
  193. MISCELLANEOUS.  This Agreement represents the 
  194. complete agreement concerning this license between 
  195. the parties and supersedes all prior agreements and 
  196. representations between them.  It may be amended 
  197. only by a writing executed by both parties.  THE 
  198. ACCEPTANCE OF ANY PURCHASE ORDER PLACED BY YOU IS 
  199. EXPRESSLY MADE CONDITIONAL ON YOUR ASSENT TO THE 
  200. TERMS SET FORTH HEREIN, AND NOT THOSE CONTAINED IN 
  201. YOUR PURCHASE ORDER.  If any provision of this 
  202. Agreement is held to be unenforceable for any 
  203. reason, such provision shall be reformed only to the 
  204. extent necessary to make in enforceable.  This 
  205. Agreement shall be governed by and construed under 
  206. California law as such law applies to agreements 
  207. between California residents entered into and to be 
  208. performed within California, except as governed by 
  209. Federal law.  The application the United Nations 
  210. Convention of Contracts for the International Sale 
  211. of Goods is expressly excluded.
  212.  
  213. U.S. Government Restricted Rights.  Use, duplication 
  214. or disclosure by the Government is subject to 
  215. restrictions set forth in subparagraphs (a) through 
  216. (d) of the Commercial Computer-Restricted Rights 
  217. clause at FAR 52.227-19 when applicable, or in 
  218. subparagraph (c)(1)(ii) of the Rights in Technical 
  219. Data and Computer Software clause at DFARS 252.227-
  220. 7013, and in similar clauses in the NASA FAR 
  221. Supplement.  Contractor/manufacturer is Netscape
